The Rules and Regulations of the accommodation facility are established to guarantee a uniform, orderly, serene and peaceful use of the facility for all. It has a contractual nature between the accommodation facility and the Guest and, therefore, the request to stay in the accommodation facility and the acceptance of this request by Myholiday Livigno implies the total acceptance of these Regulations.
The non-observance of the Rules and Regulations and of the further dispositions of the Management implies the expulsion of the transgressor from the accommodation facility and the reporting of the fact to all the national and international tourist organisations, except for the reporting also to the Public Authorities in case the non-observance could possibly lead to suppose the commission of a crime.
All specific indications on signs placed in the area owned by and/or pertaining to the facility must also be respected.
Parents (or whoever legally exercises parental authority over them) are jointly and severally responsible for the acts performed by their minor children inside the facility and are required to supervise them and ensure that they maintain polite and respectful behaviour towards others, under their own direct responsibility and, in particular, with regard to the obligation to respect silence, the proper use of the bathrooms, which cannot be considered places for playing or meeting, and the equipment made available by the facility to its Guests. Any activity that may disturb other Guests is forbidden. In general, all the rules of these contractual regulations must be respected.
The conduct of both adults and minors is considered contractually relevant and, therefore, any transgression of the rules of these regulations and the common rules of civil coexistence and good conduct of the facility will result, according to the judgment contractually delegated to the Management, the immediate termination of the contract for the Guest's actions and the removal from the facility within 5 hours of the notification of the facts. In this case, the Management of the facility is entitled to retain the sums already paid and to demand the residual sums, also by way of compensation for damages, without prejudice to the right to compensation for greater damages ascertained.
2 - ACCEPTANCE
Check-in will take place at our office located in Via Saroch 1688, or directly in the flat, the client is requested to communicate at least 2 days before departure an approximate time of arrival in Livigno. Check-in is from 16:00 onwards. Arrivals after 22:00 hours will incur an extra charge of €50.
Upon arrival, guests must hand over their documents, which will be photocopied or digitally scanned for submission to the P.S.
Guests must pay the balance of the reservation upon arrival; guests who have already paid the balance are excluded.
Minors unaccompanied by persons of legal age will only be accepted if in possession of a release form signed by their parents (or by the person legally exercising parental authority), with their contact telephone number and a copy of their ID.
The Management, as provided for by the laws of the Italian Republic in force, has the right to expel without notice anyone who does not respect the regulations or behaves in such a way as to cause damage or disturbance.
The flats are available from 4.00 p.m. on the day of arrival and are supplied complete with bed and bathroom linen and crockery; they must be vacated by 9.00 a.m. on the day of departure. Rates are per day, regardless of the time of arrival.
It is forbidden by law and to ensure the safety and peace of mind of other guests, access to the flats by persons who are not guests of the structure, except with the explicit consent of the management. The presence of unauthorised strangers will result in the immediate reporting to the Public Safety Authorities and the debiting of extra costs from the first day of the booking and, according to the judgement contractually delegated to the Management, the immediate termination of the contract due to the Guest's actions and removal from the structure within 5 hours from the contestation of the facts. Exceptionally, the Management of the facility is entitled to authorise the stay of additional persons with the possible charging of costs by withholding them from the sums already paid or to demand the residual sums.
3 - RATES
Rates are per day regardless of the time of entry.
4 - DEPOSIT, BALANCE AND CANCELLATIONS
The deposit is 50% of the amount of the stay.
The balance of the amount due must be paid within 14 days prior to check-in or certain days in advance of the day of arrival, depending on the periods and conditions of the reservation and stay. Any animals or special situations must be reported to the accommodation staff at the time of payment.
For payment of the deposit or balance, the method of payment is agreed between the parties depending on the periods of stay (bank transfer, credit cards other payment methods).
For cancellations, the full 50% deposit is charged up to 29 days before check-in and the full amount of the stay is charged for the remaining 29 days or in case of early departure or no show.
5 - SECURITY DEPOSIT
By accepting these terms and conditions, you confirm that you understand and accept the use of your credit card details to guarantee the security deposit and cover any damages to the flat during your stay.
The purpose of using your credit card details is exclusively to ensure the safety and security of the flat you have booked, covering any damages that may occur during your stay.
Your informed consent is essential for the use of your credit card details. By accepting these terms and conditions, you confirm that you are fully aware of the use of your details and that you authorise us to process them for the purposes stated.
The deposit is automatically reversed into a security deposit to cover any damages upon your arrival at the property. The deposit is NOT included in the rent, so it cannot be used as part of it. The deposit is also fully refundable within 2 days of departure, provided the following conditions are met:
No damage has been found to the property and surroundings, other than normal depreciation and wear and tear.
No fines have been incurred as a result of illegal activities, pets, subletting or services prevented during the stay.
All waste, rubbish and discards have been disposed of in the designated collection areas.
Used crockery tidied up in the same flats where it was located and placed clean in the cupboards provided.
All keys are returned to the office
Any outstanding payments must be completed before your departure.
No items of bed linen and towels are lost or damaged.
No early arrival or late departure.
Any transit authorisations for ZTL, VASP or other must be left inside the accommodation unit at the time of your departure.
The tenant has not been sent away by the landlord or his representative or the police.
We reserve the right to make changes to these terms and conditions at any time. We encourage you to check periodically for updates. Any changes will take effect upon publication on our website or direct notification.
6 - SILENCE, ORDER, BEHAVIOUR AND BEHAVIOUR INSIDE THE FACILITY
During the hours 13:00-15:00 and 22:00-08:00, any noise that may disturb the guests' rest, including a loud voice, is prohibited. The use of radio and television is permitted in extreme moderation and, in any case, in absolute compliance with the hours of silence. If, as a result of non-compliance with the above, the intervention of the Management or of the Guard and Security Staff becomes necessary, the amount of € 50.00 per hour will be charged or withheld from the security deposit, and as provided for by the laws of the Italian Republic in force, the Management has the right to expel the Client without notice as well as to report the matter to the Public Authorities.
Smoking is not permitted inside the structure.
It is forbidden to use any musical instrument, whether classical or electric and/or electronic, in the flats.
It is not permitted to move furniture and furnishings from their original arrangement.
It is not permitted to enter the flats with ski boots on one's feet.
It is not permitted to bring skis, snowboards, bicycles or other equipment into the flats.
It is not permitted to enter areas reserved for hotel staff.
It is not permitted to wax skis, sharpen edges or carry out general maintenance on bicycles or other equipment inside the facility except in the areas specifically indicated by the management.
Decent attire and respect for the sensibilities and modesty of others is required inside the facility.
It is not permitted to damage plants and flowers.
It is not permitted to throw papers and rubbish out of the bins provided.
It is not permitted to enter with weapons, knives, sticks or instruments considered blunt.
The Management, as provided by the laws of the Italian Republic in force, has the right to expel without notice anyone who does not respect the Regulations or behaves in a way that causes damage or disturbance.
The Guard and Security Staff appointed by the Management, as well as the Management itself, are obliged to enforce the Rules and Regulations against anyone. Each Client in the very act of accepting hospitality in the Structure also contractually accepts to submit to the authority of said personnel, who are in turn obliged to always respect the Laws of the Italian Republic and the commonly accepted principles of courtesy and good manners.
7 - WATER
Water is a precious asset for every community, therefore it is absolutely forbidden to use water for improper purposes. Use is permitted for primary purposes only (personal hygiene, irrigation, etc.). Guests in the facility will take care to avoid any form of waste.
8 - HEATING
The flats are equipped with central heating that is pre-programmed to provide optimal temperature and comfort in accordance with Law 10 of 1991 and Presidential Decree 412 of 1993, as amended. According to these regulations, the heating temperature in the apartments cannot exceed 20 degrees, with a tolerance of 2 degrees more, so the room temperature can never exceed 22 °C.
The heating will not be turned on with an external ambient temperature higher than 20 °C. If the customer wishes to turn on the heating to reach the maximum allowed temperature of 22 °C, he/she will be charged € 10.00 per day.
In the flats, during the winter season, it is absolutely forbidden to leave the flat with the windows and doors open, this behaviour in fact, in addition to creating enormous environmental and economic damage due to the waste of thermal energy, puts the system itself at risk as it could freeze in the event of a breakdown, it is also not permitted to open the windows and doors to keep the heating system running in order to dry any wet clothing. Clients who fail to comply with this rule will be charged an extra € 50.00 per day for heating costs and may be expelled from the facility as they put the facility and other guests at great risk.
9 - MOTORCARS-MOTORCYCLES AND MISCELLANEOUS MEANS OF CAR PARKING
For flats with available parking space, one parking space per flat is intended, regardless of the capacity of the flat.
Motorbikes and cars must park in the reserved parking area.
The guest contractually delegates to the Management the unappealable judgement on the parking of his/her own vehicle in a forbidden place and authorises as of now, raised every possible exception, the forced removal and the deposit in a place chosen by the Management itself with an extra charge for the service.
In order to ensure peace and quiet for all guests of the facility, owners or renters of particularly noisy mopeds must take care to start their vehicles outside the area reserved for parking, near the road access.
10 - DOGS AND OTHER ANIMALS
The presence of animals must be communicated at the time of booking or check-in. Animals are only accepted in certain facilities and subject to acceptance of the regulations, payment of the supplement and signing of the waiver of liability shown below.
Only pets are allowed (small and medium-sized dogs - indicatively, dogs that are transported in a pet carrier no larger than 70x30x50, weight approx. 10 kg), large dogs and all other animals including cats require written authorisation from the Management.
Management reserves the right to accept the animal at its own discretion, and in any case to refuse it if it does not comply with the guest's declaration.
Guests accompanied by animals are jointly and severally responsible for the acts performed by them inside the facility and are required to supervise them and ensure that they do not cause any damage to persons or things; they must always be kept on a leash or in special carriers in all common areas in respect of the other guests.
Animals must under no circumstances be left alone and unattended, both indoors and on the balconies, in the common areas and outside the facility, taking special care to ensure that no damage is caused to railings, seats, equipment, toys and anything else present in these areas.
Clients must be adequately equipped for the well-being of their pet. and any use of the bed and bathroom linen for the animal (grooming, bedding or other) is forbidden; if any traces (hair, excrement or other) are found on the beds or linen, the Client will be charged for the value of the contaminated item.
It is absolutely forbidden for animals to be placed on beds, sofas, chairs, tables, etc.
Guests accompanied by animals must enforce the regulations, in particular, with regard to the obligation of silence, any animal that continues to disturb during the hours of silence must immediately and obligatorily be removed from the facility.
The supplement charged per day, per flat and per animal refers to the extra time spent cleaning the room, no food or kennels will be provided.
All animals must be vaccinated, with evidence of vaccination updates.
11 - FOOD AND HYGIENIC SAFETY
Guests are not permitted to take food and drink to places other than the designated kitchens and dining rooms (e.g. in their rooms or outside the facility).
DO NOT throw anything, except toilet paper, down the drain. Any damage caused by contravening this simple rule will be retained or charged to the customer.
12 - RECEPTION AND CASHIER
Reservations, if not already made, must be paid for on the day of arrival.
Cash, credit cards and debit cards are accepted in compliance with the relevant regulations.
13 - INTERNET WI-FI
The property offers its guests the possibility to enjoy Internet connectivity via Wi-Fi, the network name and password will be provided at check-in or displayed in the flat.
14 - DEPARTURE
On the day of departure the flats must be vacated by 9:00 a.m. The keys to the flats must be handed over to our office. The bill must be settled on the day of arrival, any breakage or damage must be reported and settled before departure.
15 - TRANSFERS ON ARRIVAL AND DEPARTURE
The structure collaborates with taxi drivers of Livigno for the transfert on arrival and departure for a fee, upon request of the customer that must be received at least 7 days before the arrival and must contain presumably the scheduled times.
16 - USE OF THE FACILITIES OF THE HOTEL ON THE DAY OF DEPARTURE
Guests can use the services of the hotel within the maximum time of release of the rooms, i.e. by 9:00 a.m. on the day of departure.
At the management's discretion, guests may be granted full or partial use of the facility's services (common areas, ski room, sauna) even after 9:00 a.m. on the day of departure. In the case of obtaining the above-mentioned concession, clients are obliged to comply with the provisions of the present regulations and the rules in force until the moment of departure.
17 - MEDICAL - INFECTIOUS DISEASES
Emergency numbers are displayed in the flat.
The telephone numbers of the doctor and emergency services are contained in the list of useful numbers in the flat and can, however, be requested from the facility.
Any infectious disease must be reported to the Management.
18 - SAUNA ( available only in certain facilities )
Use of the sauna is permitted exclusively for guests of the facility. For hygienic and sanitary reasons and to guarantee the necessary privacy and tranquillity to the guests of the structure, it is absolutely forbidden to use the sauna outside the hours mentioned above.
For hygienic reasons, it is obligatory to take a shower before entering the sauna.
Children under the age of 18 are only allowed to use the sauna if accompanied by and under the supervision of their parents or guardians, and children under the age of 6 are not allowed to use the sauna if accompanied by and under the supervision of their parents or guardians.
Shouting, shouting and the use of loud voices are prohibited in the sauna.
For hygienic reasons, use of the sauna is only permitted if the seats are covered with suitable bath towels/towels. Bath towels are provided by the hotel and allocated for the duration of your stay; these must be returned on the day of departure. The towels may not be used for purposes other than sauna use.
Smoking and food consumption are not permitted in the sauna or in its immediate vicinity.
19 - BARBECUE ( available only in some facilities )
Use of the barbecue is permitted from 09:30 to 22:00 exclusively for guests of the facility. In order to guarantee guests the necessary privacy and tranquillity, it is absolutely forbidden to use the barbecue outside of the above hours.
We ask guests, after using the barbecue, to leave everything clean, tidy and make sure the fire is out.
20 - CLEANING
Garbage, after being collected in the appropriate bags located in the flats and bathrooms, must be deposited in the containers located outside the facility. It is not permitted to leave rubbish or anything else in the flats, in the common areas or in any other place other than those designated.
The client must put the kitchen equipment and crockery away in the appropriate cupboards after they have been thoroughly cleaned. The amount of the reservation and cleaning fee DOES NOT INCLUDE tidying up in the flats and washing the kitchen equipment, crockery, refrigerator and taking out the rubbish.
If the client does not clean the apartments as indicated above, the sum necessary for cleaning the premises will be deducted from the deposit, which will never be less than € 100.00.
21 - RESPONSIBILITY
The Management of the accommodation is not responsible for lack of supplies (energy, water, gas, connectivity), fortuitous failures of equipment and systems (WiFi router, heating, hot water), the loss of objects and/or valuables of the guests even in the presence of safety deposit boxes in the flat (each Guest is obliged to the diligence of the custody of the objects of his property), of damage resulting from events of force majeure and the nature of the thing (atmospheric events, natural disasters, epidemics, illnesses, falling trees or branches or products that fall within the nature of plants, gusts of wind, accidents, damage or theft of cars in the parking area and in the area of the facility). Under no circumstances will discounts be granted at the time of departure to cover any or presumed inefficiencies that may occur as a result of the events described above.
22 - SHUTTLE SERVICE (not provided)
23 - DAMAGE, THEFT AND STORAGE
Anyone causing damage to the building, movable property, equipment, etc. shall be held legally liable within the framework of the regulations in force. Intentional theft, damage and shortages will be reported immediately.
Inside the individual flats you will find a list of the units' equipment, this list is checked on each departure and it is the customer's responsibility to report any discrepancies at check-in, otherwise the customer will be held liable for any shortages.
After departure, the property staff will carry out an inspection of the flats and the costs of replacing any damage or loss of keys will be charged and are payable at check-out or will be deducted from the security deposit.
All thefts, damages and shortages may be charged to the client's card until they have been paid in full, regardless of the expiry of the security deposit freeze.
24 - AMENDMENTS TO THE REGULATIONS
The Management reserves the right to amend these Regulations at any time, which will be displayed at the entrance and published on the property's website.
